This page explains how AZEKA protects its brand, trademarks, copyright and designs, and what you may and may not do with the content on this website. It also explains how to report suspected infringement to us.

1. Our intellectual property

The AZEKA website and all of its content — including text, product photography, illustrations, graphics, icons, page design, layouts, interfaces, source code and the selection, compilation, arrangement and enhancement of that content — are owned or controlled by AZEKA, our licensors or other third parties, and are protected by copyright, trademark, design and other intellectual property laws in China and internationally.

All rights, title and interest in that content and in the associated intellectual property remain with AZEKA, our licensors or the relevant third party. We reserve all rights that are not expressly granted to you under our Terms & Conditions or under this page.

2. Trademarks

AZEKA and our associated logos, word marks and product naming are trademarks of AZEKA. Some of these marks are registered; others are used as unregistered common law marks. All such marks, together with any third-party trademarks appearing on the site, are the property of their respective owners.

Nothing on this website grants you, by implication, estoppel or otherwise, any licence or right to use any trademark, logo, service mark or trade name displayed on the site, without the prior written permission of the relevant owner. In particular, you may not:

• use our marks in any way that suggests an affiliation with, endorsement by, or sponsorship from AZEKA where none exists;
• use our marks as part of your own business name, product name, domain name or social media handle;
• bid on our marks as keywords in paid search advertising;
• use our marks in comparative advertising in a way that is misleading or denigratory; or
• register or apply to register any confusingly similar mark.

References to our products by name for the purpose of honest, factual commentary or resale of genuine goods are not prohibited, provided there is no suggestion of endorsement or partnership. If you are a retailer, distributor or affiliate and would like to use our brand assets, please contact us to discuss a licence.

3. Copyright in the website

All content on this website is protected by copyright. This includes, without limitation:

• product descriptions, buying guides, size guides and blog articles;
• product photography, lifestyle imagery, video and illustrations;
• the design, layout, look and feel of the website;
• icons, graphics and other visual elements; and
• the underlying code, including HTML, CSS, JavaScript and server-side code.

The copyright in the selection, compilation, assembly, arrangement and enhancement of the content on this site is also owned by AZEKA, and is protected as a compilation.

4. Design rights and product designs

The appearance of our products — including the shape, ornamentation and surface pattern of our footwear, insoles and accessories — may be protected by registered designs, unregistered design rights, three-dimensional trademark rights or other design protection. This protection applies independently of any copyright in photographs of those products.

Product images on this site are provided so that you can see the products before you buy. They may not be harvested, re-photographed for commercial use, or republished as your own product imagery.

5. What you may do with our content

Subject to our Terms, we grant you a worldwide, non-exclusive, non-transferable, non-sublicensable and revocable licence to:

• view and browse this website;
• download and print pages for your own personal, non-commercial use;
• save and share links to our pages on social media; and
• quote short extracts of our text, provided you clearly attribute the quote to AZEKA and include a link to the source page.

Where you copy, download or print material, you must not remove or alter any copyright, trademark or other proprietary notice.

6. What you may not do

Without our prior written consent, you must not:

1. copy, reproduce, republish or redistribute substantial parts of our content, including product descriptions and buying guides;
2. use our product photography or video on another website, marketplace, social media account or advertising campaign;
3. modify, translate, adapt or create derivative works from our content;
4. use framing, inline linking or similar techniques to display our content within another website;
5. use our trademarks or content as meta tags, hidden text or in any other concealed manner;
6. use automated tools to scrape, harvest or extract content, images or data from our site;
7. use our content to train machine learning or artificial intelligence models, or to build datasets for that purpose;
8. reverse engineer, decompile or disassemble any part of the site or its code, except as expressly permitted by law;
9. remove, obscure or alter any copyright notice, watermark, trademark or digital rights management information; or
10. use our content in a way that is misleading, defamatory, or that damages the reputation of AZEKA or the AZEKA brand.

We may also take action where content is used in a way that suggests a commercial relationship with us that does not exist.

7. Your own content and reviews

You retain ownership of the content you create and submit to us — for example a review, a photograph of yourself wearing our products, or a message to customer service.

By submitting content to us, you grant AZEKA and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute and display that content in any media, for the purpose of operating, promoting and improving our business. You can withdraw this permission for future use at any time by contacting us, although we are not required to remove material already published and we may retain archived copies.

You represent and warrant that:

• you own or control all rights in the content you submit, or otherwise have the right to grant us the permission described above;
• your content does not infringe the intellectual property, privacy or other rights of any third party;
• your content is accurate and not misleading;
• any person identifiable in your content has consented to its publication; and
• you will not submit content that breaches our Terms & Conditions.

8. Reporting infringement of your rights

We respect the intellectual property rights of others. If you believe that your copyright, trademark, design right or other intellectual property right has been infringed by content on our site, please notify us in writing with the following information:

1. your full name, postal address, telephone number and email address;
2. a clear description of the right you say has been infringed, and evidence that you own or are authorised to enforce it;
3. the exact URL or location on our site of the material you say is infringing, with enough detail for us to identify it;
4. a description of why you believe the use is not authorised by the rights holder, its agent or the law;
5. a statement that you have a good-faith belief that the disputed use is not authorised;
6. a statement that the information in your notice is accurate, and that you are the rights holder or are authorised to act on the rights holder’s behalf; and
7. your physical or electronic signature.

Where we receive a valid notice, we will investigate promptly and, where appropriate, remove or disable access to the material. We may also contact the person who submitted the material so that they have an opportunity to respond. Please note that knowingly making a material misrepresentation in a notice may expose you to liability.

9. Counter-notice

If you believe that material you submitted was removed by mistake or misidentification, you may send us a counter-notice to the same address, including:

• your name, address, telephone number and email address;
• identification of the material that was removed, and the location where it appeared before removal;
• a statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification; and
• your consent to the jurisdiction of the courts in the place where AZEKA is established, or, where you are a consumer, the courts of your place of residence, together with your physical or electronic signature.

Where we receive a valid counter-notice, we may restore the material unless the original complainant takes steps to pursue the matter.

10. Repeat infringers

We have adopted and implemented a policy providing for the termination, in appropriate circumstances, of user accounts belonging to repeat infringers of copyright or other intellectual property rights. Accounts that repeatedly receive valid infringement notices may be suspended or permanently closed, and we may decline to accept further orders from the same customer where the site has been misused in this way.

11. Third-party intellectual property

This site may display the trademarks, logos and brand names of third parties — for example payment providers, carriers, review platforms or social media services. These marks are the property of their respective owners and are used only to identify the relevant goods or services. Their appearance does not imply any endorsement, sponsorship or affiliation between AZEKA and those third parties unless we expressly state otherwise.

If you are the owner of a third-party mark appearing on our site and you would like it removed or amended, please contact us using the details in section 8.
